Senator Harry Reid Online Poker Regulation Plan Details


We'll keep saying it until it happens: ONE TIME!

Much more detail is coming out on Senator Harry Reid‘s online poker legalization bill (for a full and complete breakdown, go to Pokerati who is crushing coverage on it here).

Some key bullet points:

:: This is very much in favor of brick & mortar casinos, who were major backers of Reid’s re-election and very much want this bill pushed through. B&M’s would be immediately eligible for licenses.

:: The bill would likely exclude a merger between, say, PokerStars and MGM, where MGM hypothetically would acquire PokerStars players and platform.

:: On that note, B&M’s would have a 15-month window to operate freely without the Stars and Tilt’s of the world taking any of their domestic player share. After that, the Department of Commerce would then have a two-year window to consider what to do with offshores.

:: On that note, the UIGEA would be strengthened, making it harder for offshore operators to do business in the States. If they did, they could probably kiss any chance of obtaining a license goodbye.

:: And as is usually the case, Indian tribes will probably get screwed in this, as preferential treatment will be given to Nevada and AC casinos.

Glad we logged that vote for Reid during the mid-terms.

So why the push now and how and when will it happen? Our best educated guess: Atlantic City casinos and New Jersey intrastate action spurred the Nevada casinos to apply some pressure on Reid and get this moving. Reid would likely have the votes to get this pushed through–although he’ll need to do this in a Fristian way, likely attaching it to something like the extension of the Bush tax cuts–something Republicans wouldn’t dare vote against.

Should be an interesting 10 days or so.

Online Poker Legalization: Harry Reid Launching a Lame Duck Push?

We’ve been hearing rumblings the past week that Senator Harry Reid (D-NV) may be pushing an online poker only carve-out bill through the lame duck Senate.

Seems like those rumblings are turning into realities, as the Wall Street Journal has picked up the story now too.

Reid’s bill is backed by brick & mortar casinos, a group who used to lobby against online poker interests back in 2006.

According to the draft of the bill reviewed by The Wall Street Journal, Mr. Reid’s office is considering language that would allow only existing casinos, horse tracks and slot-machine makers to operate online poker websites for the first two years after the bill passes, which could limit the ability of other companies to enter the market.

The bill would also outsource oversight to state regulators, another move supported by existing casinos that don’t want to see the federal government become overly involved in regulating their industry.

The bill as drafted would send taxes on wagers to both federal and state governments.

Will the days of unregulated online poker in the U.S. soon be behind us?

The Federal Reserve and U.S. American Treasury announced on Friday that implementation of the UIGEA has been postponed from December 1, 2009 until June 1, 2010.

From a statement:

Agencies Extend Compliance Date for Final Rule to Implement Unlawful Internet Gambling Enforcement Act

The Department of the Treasury and the Federal Reserve Board on Friday announced the release of a joint final rule to extend the compliance date for their joint regulation implementing certain provisions of the Unlawful Internet Gambling Enforcement Act by six months to June 1, 2010.

As Pokerati noted, the timing is interesting, in that the statement was released on one of the slowest news days of the year. Kinda like when Ub released their super-user names on Friday, September 11th, 2009 at 5pm.

We’ve been speaking with many lobbyists and others “in the know” on what was going to happen come December 1st, and the overwhelming opinion was that a last minute delay was going to be pushed through. These same people mostly agreed that a poker-only “exemption” may now be pushed through/attached to the Port Securities Bill, specifically with a focus on “age restrictions” and setting limits to curb “abusive” gambling behaviors.

All in all, good news on Thanksgiving weekend.
